Terms of Service
These Terms govern your access to and use of forge. (the "Service"), operated by [Forge Entity Name], a [jurisdiction] company ("forge," "we," "us"). By connecting a wallet, creating an account, or purchasing a challenge, you agree to these Terms and to the rules published in the rulebook, which is incorporated by reference. If you do not agree, do not use the Service.
1. Eligibility & restricted jurisdictions
You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) and legally capable of entering a binding contract. Not available to persons in the US, UK, Russia, or OFAC-listed jurisdictions. You represent that you are not using a VPN, proxy, or other method to misrepresent your location, and that no law applicable to you prohibits your use of the Service. We enforce jurisdiction restrictions by IP/device geofencing and wallet screening (see the Risk Disclaimer, § 7) and may refuse or terminate service to anyone we reasonably believe is evading them.
2. What the Service is
forge sells access to trading "challenges": rule-based evaluations of trading performance on simulated accounts. Phase 1 - accounts are simulated on live Hyperliquid prices; payouts are funded by the $FORGE treasury.If you meet a challenge's profit target without breaching its daily-loss or drawdown limits, you become eligible for payouts under the profit split disclosed at purchase (80% flat) and in the rulebook. A challenge is not a deposit, an investment contract, a loan, or a custodial account - you are paying a one-time fee for the right to demonstrate trading performance against a rule set and, if successful, to receive payouts under that rule set.
3. Accounts
No KYC - your wallet is your account. Payout wallets are screened onchain.You sign in with a Google account or an external wallet via Privy, our authentication provider; we never see or store a password. You are responsible for the security of the wallet and any linked login method you use, and for all activity under your account. One account per person - see § 6 on account sharing. You are responsible for keeping your linked email and payout wallet current; forge is not liable for a payout sent to a wallet you configured incorrectly or no longer control.
4. Fees & payment
Challenge fees are one-time and disclosed in full before purchase. Fees are paid in the currency and by the method presented at checkout. Fees are non-refundable once a challenge account is created, including where the account is subsequently breached - a breach is a rules outcome, not a service failure entitling you to a refund. Where we offer a free trial account, no fee applies and this section is moot for that account. We do not currently charge monthly, inactivity, or data fees on top of the one-time challenge fee.
5. Challenge rules, breach, and payouts
Each plan's profit target, drawdown limit, daily-loss limit, and profit split are fixed at purchase and published in the rulebook; rules are never changed retroactivelyfor an account already in progress. Breaching a daily-loss or drawdown limit ends that challenge permanently - there are no resets, extensions, or second chances on a breached account. Passing a challenge makes you eligible for payouts on future profit, subject to the payout mechanics below and continued compliance with the rulebook and § 6.
Payouts are funded from an onchain reserve ($FORGE creator fees), run on a weekly epoch with a $20 minimum, and are hard-capped to onchain reserve; excess queues fifo. Per-trader, per-epoch payouts are capped at the greater of $10- see the full mechanics, including the FIFO queue for excess demand, in the rulebook. Payout wallets are screened onchain before a payout is sent; see § 7 of the Risk Disclaimer.
6. Prohibited conduct
Trading strategy is unrestricted - how you trade within the rules is entirely up to you. The following is not: exploiting platform bugs, price-feed anomalies, or latency between our simulation and Hyperliquid; sharing, selling, or operating an account on behalf of another person; running multiple accounts or wallet clusters as separate identities to evade limits or bans (Sybil abuse); hedging or offsetting positions across two or more forge accounts so one is engineered to pass; colluding with others to create offsetting exposure or farm outcomes; wash or self-trading with no genuine market risk; and latency arbitrage or stale-tick sniping against our feed. The current, canonical list - which may be extended as new abuse patterns emerge - lives in the rulebook. Violating this section results in termination of the account and forfeiture of any pending or future payout on it. We detect violations using cross-account correlation, device/IP fingerprinting, trade- and payout-pattern analysis, and onchain wallet clustering, and may suspend payouts pending investigation.
7. $FORGE and staking
$FORGE is a protocol token used for fee-sharing via staking. Staking distributions are a variable share of protocol activity (up to 40% of challenge fees) and distributions vary and can be zero. Nothing in these Terms or on this site is a promise of any rate of return, and $FORGE is not offered or sold as an investment contract. Holding, staking, or transacting in $FORGE carries price, liquidity, and smart-contract risk you assume entirely on your own; see the Risk Disclaimer.
8. Intellectual property
The forge name, marks, site, and app are our property or used under license. You're granted a limited, revocable, non-transferable license to use the Service for its intended purpose. You may not copy, reverse-engineer, scrape at scale, or resell access to the Service without our written permission.
9. No investment advice
Nothing on this site or in the app is financial, investment, tax, or legal advice, and nothing is an offer or solicitation to buy or sell any security or financial instrument. Market data, funding rates, and prices shown are informational and sourced from Hyperliquid; we do not guarantee their accuracy, completeness, or timeliness.
10. Disclaimers & limitation of liability
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure. To the maximum extent permitted by law, forge and its officers, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or loss of a challenge account, arising from your use of the Service - even if we were advised of the possibility. Where liability cannot be excluded, it is limited to the fees you paid forge in the 12 months before the claim arose.
11. Indemnification
You agree to indemnify and hold forge harmless from any claim, loss, or expense (including reasonable legal fees) arising from your breach of these Terms, your violation of law, or your use of the Service.
12. Termination
We may suspend or terminate your access to the Service at any time for a violation of these Terms or the rulebook, suspected fraud or abuse, or a legal or regulatory requirement. You may stop using the Service at any time; termination does not entitle you to a refund of fees already paid (see § 4) and does not revive a forfeited payout (see § 6).
13. Governing law & disputes
These Terms are governed by the laws of [governing-law jurisdiction - to be finalized with counsel], without regard to conflict-of-laws principles. Any dispute arising from these Terms or the Service will first be attempted to be resolved informally by contacting legal@forgecap.xyz; if that fails, the dispute-resolution forum (arbitration or courts, and where) will be specified here before launch.
14. Changes to these Terms
We may update these Terms as the Service evolves. Changes take effect when posted here with an updated "Last updated" date; for material changes we'll make reasonable efforts to notify active traders in-app. Changes never apply retroactively to rules already governing an in-progress challenge (see § 5). Continued use of the Service after a change takes effect is acceptance of it.
